General Terms and Conditions (GTC) of HerzJoy

1. Scope

These terms and conditions apply to all orders placed by consumers or businesses via the HerzJoy online shop.

2. Contracting parties and conclusion of the contract

The purchase agreement is concluded with HerzJoy – Sina Mansourikah Foumani .

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order. By clicking the order button, you submit a binding order for the goods contained in your shopping cart. The contract is concluded as soon as you receive an order confirmation by email.

3. Personalized Products

Our products are manufactured individually according to your specifications.

  • Production will only begin after payment has been received .

  • A preview or approval graphic will only be created if this has been explicitly agreed upon beforehand.

  • Texts are generally accepted exactly as entered by the customer. No spelling or grammar checks are performed.

  • Adjustments such as capitalization, line breaks or layout will be made according to the respective design and at the designer's discretion, unless explicit requests have been made.

4. Prices and Payment

All prices are quoted in euros and include VAT.

We offer secure and convenient payment options such as credit card, Klarna, and other common payment methods. Payment by bank transfer is possible after prior arrangement.

Production of personalized items only begins after payment has been received.

5. Shipping and delivery time

We deliver to Germany, Austria, the Netherlands, Belgium, Denmark and Luxembourg.

  • Production time: usually 1–3 working days

  • Shipping is via DHL

  • Delivery time within Germany: approx. 1–4 working days

  • Delivery time abroad: approx. 7–14 working days

After shipment, you will automatically receive a tracking number via email.

6. Failure to accept delivery / Incorrect delivery address

If a shipment is not delivered due to an incorrect address or failure to collect it and is returned to us, it can be reshipped. For this, we will charge a new shipping fee according to the rates specified in the shop.

7. Right of withdrawal

There is generally no statutory right of withdrawal for personalized products (§ 312g para. 2 no. 1 BGB).

Regardless of the above, we voluntarily grant a right of return of 14 days after receipt of the goods , provided that there is an error on our part or the goods were delivered damaged.

8. Warranty

The statutory warranty rights apply.

9. Liability

We are liable without limitation for intent and gross negligence, as well as for injury to life, body or health.

In the case of slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage.

10. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
